This Privacy Notice for Athletes and Professional Sportspeople is issued on behalf of the Stats Perform group of companies which includes (together with their respective subsidiaries):

(together “Stats Perform”, “us”, “we” or “our”). We are the data controller of any personal information we collect about you.

We have appointed a data protection officer (“DPO”) who is responsible for overseeing questions in relation to this Privacy Notice for Athletes and Professional Sportspeople. Stats Perform acts as a data controller in relation to the processing of personal data as set out in this Privacy Notice for Athletes and Professional Sportspeople. However, in some circumstances depending on the services we provide, we may process personal data on our customers’ behalf as a processor for the purposes of data protection laws.

Stats Perform is a sports technology organisation, providing sports data and the latest advancements in applied AI and machine learning headquartered in London and Chicago. Our products and services deliver world leading sporting predictions for teams and sportsbooks and a more engaging broadcast, media and fan experience. Stats Perform is a global organisation with offices and operations located around the world including the US, UK, Europe, Asia, South Africa, South America and Australia.

Information we collect from you and why

Information, or personal data, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymised data). The table further below sets out in detail the information that we may collect about you and how we use it:

Certain information which we collect about you may also include special category data (for example, health data as a result of sporting injuries).	See above.	In addition to being necessary for our legitimate interests as described above, processing of special category data relates to personal data which are manifestly made public by you.
Special category data (or data relating to criminal convictions).	To protect sports integrity or the integrity of a sporting event (and for the provision of services related to the same).	In addition to being necessary for our legitimate interests as described above, processing of special category (and criminal convictions) data may be necessary for the purposes of measures designed to protect the integrity of a sport or a sporting event and is necessary for reasons of substantial public interest.

Who does Stats Perform share my information with?

We may disclose your information to the following categories of recipients:

to our customers in connection with the provision of our services;
to our group companies;
other than our customers, to our other data licensees (including without limitation sports technology companies, sports fans, leagues, sports federations, coaching partners, teams, clubs, media partners and betting operators);
to third party vendors and our other technical partners who provide data processing services to us (for example, data hosting and/or analytics), or who otherwise process personal information for purposes that are described in this Privacy Notice for Athletes and Professional Sportspeople or notified to you when we collect your personal information;
to any competent law enforcement body, regulatory body, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to detect and investigate illegal or wrongful activities and/or breach of contract, (iv) to exercise or protect the rights, property, or personal safety of Stats Perform, its customers, staff or others, (v) to protect your vital interests or those of any other person;
to purchasers and third parties in connection with a business transaction: your personal information may be disclosed to third parties in connection with a transaction, such as a merger, sale of assets or shares, reorganisation, financing, change of control or acquisition of all or a portion of our business;
to a potential buyer (and its agents and advisers) in connection with any proposed purchase, merger or acquisition of any part of our business; and
to any other person as may be envisaged under this Privacy Notice.

Aggregated data

We may collect, use and share “aggregated data” such as statistical or demographic data for any purpose. This aggregated data could be derived from your personal information but is anonymised and not considered personal information as this data will not directly or indirectly reveal your identity. For example, we may aggregate your and your teammates’ personal data to calculate the team statistics. Such data would not constitute your personal data. We may also use anonymised, aggregated, statistical information for purposes that include testing our IT systems, research, data analysis, machine learning, improving our websites and/or developing new products and features. We may also share such anonymised information with third parties.

Security

We understand that the security of your information is important to you. When handling information, security is paramount and we seek to ensure that information is adequately and appropriately protected. We have put in place appropriate technical and organisational measures to prevent accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to your personal information. The measures we use are designed to provide a level of security appropriate to the risk of processing information. Data is encrypted as appropriate and data access is restricted to authorised roles within the company only. Our data processing/storage standards and access are regularly reviewed.

International Data Transfers

We are a global business. This means that it may be necessary for us to transfer your personal information outside of the country in which it was collected, or the jurisdiction of your residence or location, when transferring it to other entities or offices within Stats Perform as well as our customers, data licensees, service providers and business partners located in other countries. If you are based in the UK or European Economic Area (“EEA”), your personal information may be transferred to or accessed from territories outside the UK or EEA which are not governed by data protection laws equivalent to those in force within the UK and EU respectively.

Where applicable data protection laws apply, and personal information is transferred by us, and/or made available, to a recipient outside the EEA or UK, we take steps to put in place appropriate safeguards to protect your personal information, including:

transferring your personal information to a country, territory, sector, or international organisation which the appropriate supervisory authority has determined ensures an adequate level of protection, as permitted under applicable data protection laws; or
entering into standard contractual clauses in a form approved by the appropriate supervisory authority, obliging recipients to protect your personal information as required under applicable data protection laws.

How Long We Retain Your Information

We retain information we collect about you as long as we have an ongoing legitimate business need to do so (please see the table in the ‘Information we collect about you and how we use it’ section above). Usually, it is in our business interests to retain sports statistical information, though, where necessary, we ensure such information is updated.

When we have no ongoing legitimate business need to process information, we will either delete or anonymise it or, if this is not possible at the time (for example, because your information has been stored in backup archives), then we will securely store the information and isolate it from any further processing until deletion is possible.

Your Rights
