We are the data controller of any personal information we collect about you and we are responsible for: www.statsperform.com; www.scoresway.com; www.automatedinsights.com; https://optaplayerstats.statsperform.com; and www.theanalyst.com as well as any other websites owned and operated by Stats Perform from time to time (together the “Websites”).

We have appointed a data protection officer (“DPO”) who is responsible for overseeing questions in relation to this Privacy Notice. What does Stats Perform do?

Stats Perform is a sports technology organisation, providing sports data and the latest advancements in applied AI and machine learning, headquartered in London. Our products and services deliver world leading sporting predictions for teams and sportsbooks and a more engaging broadcast, media and fan experience. Stats Perform is a global organisation with offices and operations located around the world including the US, UK, Europe, Asia, South Africa, South America and Australia.

Information we collect from you and why

Personal information, or personal data, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymised data). The table further below sets out in detail the personal information that we may collect about you, which broadly falls into the following categories:

Information that you provide voluntarily

Certain parts of our Websites may ask you to provide personal information voluntarily: for example, we may ask you to provide your contact details (e.g. name, email address and geographic location) in order to subscribe to marketing communications from us, and/or to submit enquiries to us. The personal information that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your personal information. You may also provide us with personal information, such as your contact details, when interacting with Stats Perform generally by email, over the phone, at online and physical events or in the course of your and/or business activities.

Information that we collect about you

When you visit our Websites, we may collect certain information automatically from your device. In some countries, including the UK and countries in the European Economic Area, this information may be considered personal information under applicable data protection laws.

Specifically, the information we collect automatically may include information like your IP address, device type, unique device identification numbers, browser-type, broad geographic location (e.g. country or city-level location) and other technical information. We may also collect information about how your device has interacted with our Websites, including the pages accessed and links clicked.

Collecting this information enables us to better understand the visitors who come to our Websites, where they come from, and what content on our Websites is of interest to them. We use this information for our internal analytics purposes, to improve the quality and relevance of our Websites to our visitors and for marketing and advertising.

In our email marketing, we are able to track delivery and log when emails are opened. You can restrict or block this type of technology through your web browser or email programme settings by preventing automatic downloading. Cookies may also be set if you click on a link within the email.

Information that we obtain from third party sources

From time to time, we may receive personal information about you from third party sources such as social networks, public databases (where permitted by law), corporate websites, your business associates and our representatives, agencies (including recruitment agencies and credit reference agencies) and partners (for example, where we carry out joint business activities that involve you).

Information that we obtain as part of providing our services

In relation to some of our services, under certain circumstances, we may need to collect certain information about the clients’ customers, end users or online players, such as their IP address (or related information) and general location, for specific purposes, such as to enforce geo-restrictions and prevent unauthorised access, ensure our services are being used properly, to monitor and improve service quality and for security and fraud-prevention purposes.

How we use your information

We use the information we collect in relation to you to correspond with you, perform our agreements (including with you or the organisation you represent), comply with our regulatory responsibilities and policies, carry out marketing activities and day-to-day business activities and operations.

We will indicate to you where the provision of certain personal information is required in order for us to provide you certain services. If you choose not to provide such personal information, we may not be able to provide the services you have requested.

Who does Stats Perform share my personal information with?

We may disclose your personal information to the following categories of recipients:

to our group companies,
to third party vendors and our other partners who provide data processing services to us (for example, to support the delivery of, provide functionality on, or help to enhance the security of our Websites or perform services generally such as email, marketing, advertising, fraud prevention, background checks, web hosting or analytics), or who otherwise process personal information for purposes that are described in this Privacy Notice or notified to you when we collect your personal information;
to any competent law enforcement body, regulatory body, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, (iii) to detect and investigate illegal or wrongful activities and/or breach of contract, (iv) to exercise or protect the rights, property, or personal safety of Stats Perform, its customers, staff or others, or (v) to protect your vital interests or those of any other person;
to purchasers and third parties in connection with a business transaction: your personal information may be disclosed to third parties in connection with a transaction, such as a merger, sale of assets or shares, reorganisation, financing, change of control or acquisition of all or a portion of our business;
to a potential buyer (and its agents and advisers) in connection with any proposed purchase, merger or acquisition of any part of our business; and
to any other person as may be envisaged under this Privacy Notice.

Marketing

Where permitted by applicable law, we and/or our selected third parties may contact you by sending our newsletters, sport-related material or information about our organisation, offers, updates, products and services that might be of interest to you. We will only send you marketing messages if you have given us your consent to do so, unless consent is not required under applicable law. Where you provide consent, you can withdraw your consent at any time, but without affecting the lawfulness of our processing based on consent before its withdrawal. In any case, if you no longer wish to receive marketing communications, you can click on the ‘unsubscribe’ link at the bottom of any of our marketing emails.

We also participate in interest-based advertising and use third party advertising companies to serve you targeted advertisements based on your online browsing history and your interests. To do this, we or our advertising partners may collect information about how you use or connect to the Websites, or the types of other websites, social media services, content and ads that you (or others using your device) visit or view or connect to our Websites so that we or our advertising partners may play or display ads on the Websites, on other websites, apps or services you may use, and on other devices you may use.

Aggregated data

We may collect, use and share anonymised “aggregated data” such as statistical or demographic data for any purpose. This aggregated data could be derived from your personal information but is anonymised and not considered personal information as this data will not directly or indirectly reveal your identity. For example, we may use anonymised, aggregated, statistical information for purposes that include testing our IT systems, research, data analysis, improving our Websites, developing new products and features and/or to calculate the percentage of users accessing a specific Website feature. We may also share such anonymised information with third parties.

Special category information

We do not generally seek to collect sensitive (or “special category”) personal information through our Websites but may do so as part of our business transactions. If we do collect special category personal information, we will require your explicit consent, or rely on an alternative appropriate lawful basis (such as because the processing relating to personal information is manifestly made public) for our proposed use of that information at the time of collection.

Children

Except for sports data collected about athletes, or unless otherwise specified (for example, in relation to certain aspects of our services), we do not knowingly collect or process personal data from children under 18 years of age.

Security

We understand that the security of your personal information is important to you. When handling personal information, security is paramount, and we seek to ensure that personal information is adequately and appropriately protected. We have put in place appropriate, technical, and organisational measures to prevent accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to your personal information. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information. Data is encrypted as appropriate and data access is restricted to authorised roles within the company only. Our data processing/storage standards and access are regularly reviewed.

International Data Transfers

We are a global business. This means that it may be necessary for us to transfer your personal information outside of the country in which it was collected, or your jurisdiction of residence or location, when transferring it to other entities or offices within Stats Perform and our service providers and business partners located in other countries. If you are based in the UK or European Economic Area (“EEA”), your personal information may be transferred to or accessed from territories outside the UK or EEA which are not governed by data protection laws equivalent to those in force within the UK and EU respectively.

Where applicable data protection laws apply, and personal information is transferred by us, and/or made available, to a recipient outside the EEA or UK, we take steps to put in place appropriate safeguards to protect your personal information, including:

transferring your personal information to a country, territory, sector, or international organisation which the appropriate supervisory authority has determined ensures an adequate level of protection, as permitted under applicable data protection laws; or
entering into standard contractual clauses in a form approved by the appropriate supervisory authority, obliging recipients to protect your personal information as required under applicable data protection laws.

How Long We Retain Your Personal Information

We will store the personal information we collect about you for no longer than necessary for the purposes set out in the table above in accordance with our legal obligations and legitimate business interests. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise it or, if this is not possible at the time (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

To determine the appropriate retention period for personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, reporting or other requirements.

Your Rights

To the extent applicable under data protection laws, you have the following data protection rights:

Right of access. You have the right to obtain access to your personal information.
Right of portability. You have the right, in certain circumstances, to receive a copy of the personal information you have provided to us in a structured, commonly used, machine-readable format that supports re-use, or to request the transfer of your personal data to another person.
Right to rectification. You have the right to obtain rectification of any inaccurate or incomplete personal information we hold about you without undue delay.
Right to erasure. You have the right, in some circumstances, to request for us to erase your personal information without undue delay if the continued processing of that personal information is not justified.

You have the right, in some circumstances, to require us to limit the purposes for which we process your personal information if the continued processing of the personal information in this way is not justified, such as where the accuracy of the personal information is contested by you.
Right to withdraw consent. If you have provided consent to any processing of your personal information, you have a right to withdraw that consent. Withdrawing your consent will not affect the lawfulness of any processing we conducted with your consent prior to your withdrawal.

The right to object: You also have a right to object to any processing based on our legitimate interests where there are grounds relating to your particular situation. There may be compelling reasons for continuing to process your personal information, and we will assess and inform you if that is the case. You can object to marketing activities for any reason. Changes to this Privacy Notice are effective when they are posted on this page.
